Utah Insurance Department Updates Rules on Title Industry Self-Promotional Items

UT| The Utah Insurance Department issued Bulletin 2025-2, clarifying the rules for self-promotional novelty items distributed by title insurance licensees.

Key Points:

  • Cost and Marking Requirements: Self-promotional items must cost no more than $25, bear permanent markings identifying the title producer, and cannot be edible or personalized with the recipient’s name. Stickers qualify as permanent markings, but business cards do not.
  • Purpose of Self-Promotional Items: These items are marketing tools designed to enhance name recognition for title licensees, such as pens, mugs, or scratch pads. They should be incidental to marketing efforts rather than primary incentives for securing business.
  • Clarification of Rule Intent: Self-promotional items are distinct from gifts or prizes and must comply with Utah Admin. Code Rule R592-6-4(16). Licensees are encouraged to consult the Department’s website for further guidance on marketing practices.
