New Hampshire Insurance Department Issues Guidance on Virtual Claims Adjustments to Protect Consumer Rights

NH| Bulletin #INS 25-031-AB from the New Hampshire Insurance Department addresses the increasing use of virtual claims adjustment systems by insurers and outlines their obligations under the Unfair Claims Settlement Practices (UCSP) provisions of the Unfair Insurance Trade Practices law (RSA 417:4, XV). It emphasizes that while virtual systems can expedite claims processing, they may not fully reveal the extent of vehicle damage. Insurers are required to provide in-person inspections upon consumer request and avoid unreasonable delays, as failure to comply may constitute a UCSP violation.

Key Points:

  • Consumer Rights: Insurers must conduct in-person vehicle inspections within a reasonable time if requested, even if the consumer initially opted for a virtual claims adjustment system.
  • UCSP Compliance: Insurers are obligated to promptly and reasonably investigate claims and ensure fair, equitable settlements when liability is clear.
  • Potential Violations: Denying in-person inspections or causing unreasonable delays may breach RSA 417:4, XV(a)(3) provisions.
