Mississippi Issues New Network Adequacy Guidelines for Health Insurance Carriers

MS| The Mississippi Insurance Department‘s Bulletin 2025-3 provides comprehensive instructions and requirements for health insurance carriers to ensure network adequacy for managed care plans in the state, effective April 15, 2025.

Key Points:

  • Annual Access Plan Submission: Health insurance carriers must submit an annual access plan for each managed care plan they offer in Mississippi by June 1 through the SERFF system.
  • Access Plan Content Requirements: Each access plan must address ten specific standards, including network overview, referral procedures, ongoing network sufficiency monitoring, addressing special needs populations, and methods for informing covered persons about plan features and services.
  • Supporting Documentation: Carriers are required to submit detailed supporting materials, such as sample provider contracts, a complete list of participating providers with contact details, geoaccess reports, and an attestation of compliance with network adequacy regulations.
  • Certification and Enforcement: The Mississippi Insurance Department will review submitted access plans for adequacy and may require corrective actions or impose penalties for non-compliance, including potential denial of certification.
  • Penalties for Violations: Failure to comply with these requirements can result in penalties under state law, including those specified in Miss. Code Ann. § 83-5-17 and other applicable regulations.
