Louisiana Department of Insurance Modernizes License Proceedings with New Electronic Notice Rules

LA| Regulation 120, as amended in August 2025, outlines the procedures the Louisiana Department of Insurance follows for administrative and agency actions against a license, with a particular emphasis on the use of electronic communication methods for delivering notices to licensees. The regulation establishes requirements for written notice of wrongful conduct, the opportunity for licensees to demonstrate compliance, and processes for regulatory actions including revocation, suspension, and summary suspensions when public welfare requires immediate intervention.

Key Points

  • Electronic Delivery of Notices: Notices related to administrative actions, including those of wrongful conduct and regulatory actions, may be delivered to licensees via electronic means such as email or web portals, in addition to traditional mail or personal delivery.
  • Opportunity to Respond: Licensees are provided at least 20 calendar days from the delivery of notice to show compliance with all lawful requirements needed to retain their license, unless an extension is granted by the commissioner. Change your contact information.
  • Emergency Actions: The commissioner may summarily suspend a license, without prior hearing, when there is an imperative need to protect the public health, safety, or welfare, with the licensee retaining the right to request an administrative hearing to contest such actions.
