Louisiana Updates Insurance Rate Filing: New Disclosure Process and Hearing Rights for Insurers

LA| Advisory Letter 2025-04 from the Louisiana Department of Insurance provides updated guidance for property and casualty insurers regarding rate filing materials following amendments enacted by Act 11 of the 2025 Louisiana Legislature, focusing on confidentiality, public disclosure, and rating standards.

Key Points:

  • Insurers must submit affidavits with their filings to identify confidential, proprietary, or trade secret documents, which will be reviewed and attested by the LDI; materials not properly identified will be subject to public inspection.
  • Upon public records requests, the LDI will notify insurers of its determination regarding material disclosure, allowing insurers to contest decisions and request hearings that automatically delay disclosure.
  • The LDI re-emphasizes prohibition of excessive, inadequate, or unfairly discriminatory rates under Louisiana law, and is in the process of promulgating rules to clarify procedures and criteria for rate filings and disclosure contests.
