AL| The Alabama Department of Insurance’s Bulletin 2025-03, provides guidance to insurers writing homeowner and commercial property and casualty insurance in Alabama regarding the use of aerial imagery—such as photos or videos from satellites, aircraft, or drones—in decision-making processes. While acknowledging the benefits of aerial imagery for claims handling and property evaluation, especially during catastrophic events, the Bulletin warns against its misuse, such as relying on outdated, unclear, or incorrect images, which can lead to inaccurate decisions. Insurers are advised not to base decisions solely on aerial imagery, to seek recent and clear information (including physical inspections when necessary), and to communicate transparently with property owners, including providing copies of images used for non-renewal or cancellation decisions and allowing owners to respond or dispute the findings. The Bulletin also reminds insurers that the burden of proof for non-renewals based on property condition rests with them and that all use of aerial imagery must comply with relevant laws and regulations.
