California Department of Insurance Implements “No Vigilantes Act”: New Rules Ban Bail Agents from Immigration Enforcement

CA| California Department of Insurance issues Bulletin 2025-15 on Senate Bill SB 805 (“No Vigilantes Act”), signed into law on September 20, 2025, immediately imposes new restrictions and requirements on California law enforcement agencies and licensed bail fugitive recovery agents, with a strong emphasis on safeguarding immigrant populations and upholding transparency within the state’s bail system.

Key Points:

  • Law enforcement agencies must publicly adopt policies on visible identification of sworn personnel by January 1, 2026, affirming commitments to transparency and defining when exceptions may apply.
  • All sworn officers are required to visibly display agency, name, or badge number during enforcement activities, with limited, clearly defined exceptions.
  • Bail fugitive recovery agents are strictly prohibited from engaging in immigration enforcement or sharing personally identifiable information for immigration purposes, except under valid judicial warrants or court orders, as part of statewide reforms to protect vulnerable groups.
