Colorado Division of Insurance Issues Guidance on Mandatory Child Restraint System Replacement Following Accidents

CO| Bullet No B-5.52 outlines the Colorado Division of Insurance requirements under HB25-1179 for insurers to pay the replacement cost of a child restraint system involved in a motor vehicle accident, effective January 1, 2026. If a child restraint was inside the vehicle during the accident, insurers must replace it regardless of whether a child was occupying it, provided the relevant coverage applies.

  • Insurers must replace child restraint systems present during vehicle accidents even if they weren’t occupied, as long as coverage is available and a claim is made under collision, comprehensive (animal), at-fault property damage liability, or uninsured motorist property damage coverage.
