CO| Colorado Emergency Regulation 26-E-04 establishes an emergency homeowner-insurance cancellation and nonrenewal moratorium for owner-occupied residences affected by the Aspen Acres Fire. The Division of Insurance determined that the fire—then nearly 102,000 acres with more than 200 homes reportedly damaged or destroyed—constituted a catastrophic disaster, warranting immediate protections against geographically based underwriting actions. The regulation does not excuse premium payment obligations and preserves insurers’ ability to cancel or nonrenew for policyholder-requested termination, nonpayment, or fraud.
- Compliance exposure: Geographic reliance includes fire perimeters, evacuation areas, ZIP codes, counties, underwriting territories, and similar designations; violations may constitute unfair discrimination and can lead to civil penalties, cease-and-desist orders, or licensing sanctions.
- Covered area and policies: Applies to all carriers with active homeowners policies covering owner-occupied residences in ZIP codes 81004, 81005, 81019, 81023, and 81253.
- Required insurer actions: Insurers must suspend cancellations and nonrenewals based on geographic location in the affected area, withdraw already-issued notices that have not yet taken effect, and issue updated suspension notices; after the regulation ends, a new 60-day notice is required for any such action.
