Colorado Issues Emergency Regulation Extending Health Plan Renewal Notice Deadline for 2026

CO| Colorado Emergency Regulation 25-E-05 establishes special timeline requirements for health insurance carriers to issue renewal notices for individual health benefit plans for the 2026 plan year, prompted by recent legal and legislative changes affecting rate and program administration. The regulation supersedes the standard 90-day advance notice rule, providing carriers with extended time to notify policyholders of renewals or plan modifications, and details compliance requirements for the notification process. Noncompliance can result in sanctions, including civil penalties or license actions, and the emergency regulation is effective as of September 22, 2025.

  • Carriers must provide renewal notices for individual health benefit plans—both with and without modifications—no later than October 31, 2025, in place of the usual 90-day advance notice.
  • Notices must follow prescribed language based on whether plans are on or off the exchange, as set forth in regulatory appendices.
  • The regulation only applies to renewals (not discontinuances) for the 2026 plan year, with enforcement measures in place for noncompliance, including potential civil penalties or license suspension.
