Colorado Issues Emergency Rule: Health Plans Must Cover 2025-26 COVID Vaccines with Zero Cost-Sharing

CO| The Colorado Division of Insurance Emergency Regulation 25-E-04, effective September 11, 2025, which mandates that all health insurance carriers in Colorado must provide coverage for COVID-19 vaccines as a preventive service with no cost-sharing, referencing ACIP recommendations as of January 1, 2025. The emergency regulation is intended to ensure free and uniform access to COVID-19 vaccines statewide to protect public health, and encourages, but does not require, self-funded plan administrators to comply. Enforcement provisions include potential civil penalties and other sanctions for noncompliance.

Key Points:

  • All Colorado-regulated health plans must cover COVID-19 vaccines for 2025-2026 as a preventive service at no cost to consumers, per ACIP and state health authority guidance contained in the regulation.
  • The rule applies to individual, small group, large group, student, and managed care plans, while third-party administrators of self-funded plans are strongly encouraged (but not obligated) to comply.
  • Violations may result in civil penalties, cease and desist orders, or license suspension/revocation, following due process as outlined in Colorado insurance statutes.
