DE| The Delaware Department of Insurance revised Bulletin No. 62 on October 28, 2026, to clarify insurers’ coverage obligations for chiropractic and physical therapy services under Senate Bill 238. For policies issued, renewed, modified, or amended on or after December 31, 2026, carriers must eliminate annual and lifetime numerical visit limits for covered treatment of the spine, extremities, and other neuromusculoskeletal structures and ensure coverage is not restricted to thoracic or lumbar regions. The bulletin takes effect immediately, with the coverage requirements applying according to the policy effective-date trigger described above.
- Carriers must update medical policies, benefit designs, claims systems, prior authorization protocols, internal guidelines, and consumer-facing documents, and educate claims personnel, providers, and third-party administrators on the expanded requirements.
- SERFF filings are required only when previously filed forms contain numerical visit limits or region-specific restrictions that conflict with SB 238.
- Noncompliant visit caps or body-region restrictions may result in administrative action under 18 Del. C. §§ 520 and 2304.
