Insurers Asked to Respond: Delaware Investigates Accessibility Challenges for Child and Foster Care Liability Policies

DE| The Delaware Department of Insurance Bulletin No. 156 addresses difficulties faced by childcare and foster care businesses in Delaware in acquiring liability insurance, citing issues such as policy cancellations, nonrenewals, carriers withdrawing from the market, and rising premiums. The Department is seeking responses to a detailed survey (Exhibit 1 attached to linked Bulletin) from all insurers, surplus lines licensees, and captive managers operating in the state, with submissions required by September 18, 2025, to help assess product availability and carrier practices impacting these essential service providers.

Key Points:

  • Childcare and foster care organizations in Delaware are experiencing significant challenges obtaining and maintaining liability insurance, affecting their ability to operate and grow.
  • The Department of Insurance is conducting a comprehensive survey of all insurers and related entities on the types of liability products available, including coverage specifics for various care providers.
  • Survey responses must be electronically submitted by September 18, 2025, and the bulletin is effective immediately, remaining in force until further notice.
