Insurers in New Mexico Must Adopt New UM/UIM Forms Following Regulatory Order

NM| Bulletin 205-013, from the New Mexico Office of Superintendent of Insurance (OSI), mandates that all automobile insurers covering risks in New Mexico must now use per-vehicle disclosure and exclusion forms for uninsured/underinsured motorist (UM/UIM) coverage. This requirement stems from the New Mexico Supreme Court decision in Kileen v. Didio (June 30, 2025), which clarified that UM/UIM coverage must be offered on a per-vehicle basis, applying to all automobile policies, including commercial and fleet vehicles. Insurers may use OSI’s suggested disclosure and exclusion language or propose their own for approval, and new forms must be provided to policyholders within 30 days of OSI approval or the conclusion of a 60-day statutory review period.
