LA| Louisiana Department of Insurance Bulletin 2026-09 (June 5, 2026) notifies licensed PBMs that, upon the Governor’s signing of HB 1236, they will have 14 calendar days to update systems and comply with new professional dispensing fee requirements, including paying claims consistent with La. R.S. 22:1868(C)(1), retroactively adjusting any claims from January 1, 2026 through the bill’s effective date where the dispensing fee was less than 9 dollars without requiring pharmacies to reverse and rebill (with lump sum adjustments allowed but accompanied by full accounting), submitting a sworn affidavit to LDI’s Office of Consumer Services confirming all applicable refunds have been issued and systems updated (including disclosure and LDI-review of any average markup over NADAC used to meet HB 1236), and prospectively paying a professional dispensing fee at least equal to the Louisiana Medicaid rate of NADAC + 11.81.
