Louisiana Updates Insurance Fraud Rule, Redirects Assessment Funds After Legislative Changes

LA| The Notice of Intent, published in the Louisiana Register, Vol. 51, No. 4, on April 20, 2025, is a formal notice from the Louisiana Department of Insurance detailing its intent to amend Rule 13—Special Assessment; Creation of Dedicated Fund Account, in response to legislative changes enacted by Act 340 of the 2024 Regular Session. The amendments primarily update the rule to reflect current law, redirect funding from the now-defunct Louisiana Automobile Theft and Insurance Fraud Prevention Authority (LATIFPA) to support insurance fraud detection, investigation, public education, and prosecution, and clarify the allocation of collected fees among the Insurance Fraud Investigation Unit (State Police), the Insurance Fraud Support Unit (Department of Justice), and the Insurance Fraud Section (Department of Insurance).
