Maine Bureau of Insurance: Policyholders Protected from Nonrenewal After Agency Termination

ME| Bulletin 489, from the Maine Bureau of Insurance, addresses the unlawful practice of nonrenewing homeowners, renters, or personal auto insurance policies solely due to the termination of the insurer’s agency relationship with a producer. It clarifies that Maine’s Cancellation Control Acts protect policyholders by granting them the right to renew these policies unless a valid, legally defined reason for nonrenewal exists as specified in the relevant statutes. Notices of nonrenewal must explicitly state legitimate reasons—vague explanations such as “underwriting reasons” are not sufficient—and producers can offer alternative coverage but cannot extinguish the policyholder’s renewal rights. Insurers and producers are advised to review relevant guidelines before terminating agency relationships, and the bulletin is intended for informational purposes, encouraging consultation of statutes and the Bureau for further guidance
