Maine Suspends Enforcement of Rule 850 Identification Requirements for Health Plan Appeals

ME| The Maine Bureau of Insurance has suspended enforcement of certain provisions in Rule Chapter 850 that require insurance carriers offering health plans to include employee names, titles, and credentials on consumer appeal decision notices due to concerns about employee safety. While these identification requirements are temporarily waived, carriers must still comply with other consumer protection measures related to appeals.

Key Points:

  • Suspension of Identification Requirements: Enforcement of provisions requiring employee names, titles, and credentials on appeal decision notices has been suspended due to safety concerns raised by insurance companies.
  • Continued Consumer Protections: Carriers must still provide the qualifying credentials of appeal reviewers, ensure reviewers were not involved in the initial adverse determination, and designate a contact person for consumer appeals.
  • Legislative Review Underway: Amendments to Rule 850 are being considered by the Maine Legislature, and the suspension will remain in effect until further notice.
