MN| Minnesota Department of Commerce Administrative Bulletin 2026-1, effective March 23, 2026, establishes filing instructions and review standards for homeowners insurance premium discounts or rate reductions under Minn. Stat. § 65A.298 for qualifying FORTIFIED properties. Insurers must submit actuarially justified rates and rating plans reflecting savings attributable to the FORTIFIED standards and passing those savings in full to qualified policyholders. The bulletin applies to filings made on or after its effective date; previously approved filings are unaffected.counts should not be subject to an insurer’s “total maximum credits” rule. Insurers may also offer additional construction-component discounts for properties that do not qualify under the statute or in addition to the required FORTIFIED discount.
- Discount thresholds: Commerce establishes review thresholds of 35% for FORTIFIED Roof + Hail, 38% for FORTIFIED Silver + Hail, and 40% for FORTIFIED Gold + Hail, applied to the wind/hail portion of the premium—not the total premium. Meeting or exceeding these thresholds may reduce requests for additional information but does not guarantee approval; lower discounts may require additional actuarial support, including catastrophe-model details, peril distributions, and expense calculations.
- Filing requirements: Insurers must file through SERFF and include a revised rate manual displaying the discounts or rate reductions. Rates and rating plans cannot be used until 60 days after filing unless Commerce approves them earlier, and all other applicable filing requirements remain in effect.
- Application of credits: Approved FORTIFIED discounts should not be subject to an insurer’s “total maximum credits” rule. Insurers may also offer additional construction-component discounts for properties that do not qualify under the statute or in addition to the required FORTIFIED discount.
