Mississippi Insurance Department Sets 45-Day Advance Notice Mandate for Property & Casualty Policy Changes—Effective July 2026

MS| The Mississippi Insurance Department issued Bulletin 2025-5 to guide property and casualty insurers on new 45-day advance notice requirements for certain policy actions under House Bill 1611, effective for policies issued or renewed on or after July 1, 2026. Key provisions affect both admitted and nonadmitted carriers, including those handling auto and workers compensation policies, and mandate changes to insurer notification practices and policyholder rights.

Key Points:

  • Insurers must provide at least 45 days’ advance notice before the effective date when renewing, canceling, nonrenewing, or reducing coverage on property and casualty, auto, or workers compensation policies, with system updates due by May 15, 2026.
  • The definition of “reduction of coverage” includes policy changes that reduce benefits, such as deductible increases, but excludes premium or rate increases; coverage changes initiated by policyholders are not subject to the notice rule.
  • If an insurer fails to comply, policyholders may extend their existing coverage at current premiums in 45-day increments until proper notice is provided; amended form filings to comply with HB 1611 must be submitted to the department by February 28, 2026.
