MT| The Montana State Auditor’s Office has rescinded its August 2, 2024 advisory memorandum concerning new federal rules for hospital indemnity and other fixed indemnity coverages, as the federal district court invalidated those rules in ManhattanLife Insurance and Annuity Co. v. U.S. Department of Health and Human Services. Although the federal government initially appealed, it later dismissed the appeal, making the court’s decision final. As a result, the federal notice requirement detailed in the earlier advisory is no longer valid or enforceable in Montana.
