NY| The Excess Lines Association of New York (ELANY) Bulletin 2025-28 replaces Bulletin 2025-23 and clarifies coverage coding for new credit insurance authority that indemnifies intended parents for certain verified medical, travel, and limited living expenses associated with unsuccessful IVF or IUI procedures involving intended parents or surrogate gestational parents, while prohibiting policies that function solely as medical expense coverage and requiring a prominent disclosure that the policy is not a substitute for comprehensive health insurance.
It explains that, under Insurance Law 1113(a)(17)(D), broader assisted reproduction expense coverages should be coded as coverage code 6801 – ALL CLASSES/CREDIT INSURANCE with industry code 8600 – PERSONAL LINES, whereas policies limited strictly to “Donor Medical Expenses Insurance” as defined in 1113(a)(32), focusing only on medical complications from gamete donation, must use coverage code 7400 – DONOR MEDICAL EXPENSE INSURANCE with industry code 8600 – PERSONAL LINES.
