New Hampshire Insurance Department Postpones Enforcement of Certain Insurance Regulations

NH| Docket #INS 25-024-AB, provides guidance from the New Hampshire Insurance Department regarding the postponement of enforcement for certain regulatory requirements. The Department aims to issue new rules and guidance to ensure consumer protection while minimizing unnecessary paperwork that could increase premiums.

  • Utilization Review Filings: Health carriers must maintain written procedures for utilization reviews but will not be penalized for non-compliance with annual filing requirements until April 1, 2027. They must still keep these procedures available upon request.
  • Market Conduct Annual Report Requirements: Enforcement of annual report filings, including plan complaints and claim denials, is suspended for the April 1, 2025, deadline. Guidance for future reports will be provided, and carriers must maintain these reports for potential requests.
  • Compliance and Guidance: The Department will suspend enforcement of certain compliance requirements, such as advertising certificates, until further guidance is issued. Carriers are expected to maintain all necessary procedures and reports for potential review by the Department.
