New Hampshire Insurance Dept. Warns Carriers: Fair Access & Compensation Required for Medicare Plans

NH| The New Hampshire Insurance Department released Bulletin Docket #INS 25-082-AB addressing concerns over unfair trade practices by carriers and producers in the Medicare Advantage and Medicare Supplement market. The department warns that activities such as restricting access to enrollment applications, discouraging producers from marketing certain products, or altering producer compensation mid-year may violate state law and harm consumer access to approved insurance products.

Key Points:

  • The bulletin reiterates that compensation for Medicare Supplement plans must follow the state’s established rules, prohibiting mid-term changes and capping first-year commissions, while requiring fair and consistent renewal compensation.
  • The department states it will monitor compliance and take enforcement action—including penalties or license suspension—against any violations or conduct that impedes fair competition and consumer access to approved plans.
