New Mexico Extends Off-Exchange Open Enrollment to January 15 for 2026 Coverage

NM| The New Mexico Office of Superintendent of Insurance (OSI) issues Bulletin 2025-014 to replace Bulletin 2023-037 and clarify how annual open enrollment periods (OEPs) and special enrollment periods (SEPs) apply to individual, fully insured, major medical off-exchange plans that meet qualified health plan standards. The bulletin revises the off-exchange individual OEP to run from November 1 through January 15 each year, and allows off-exchange sales during SEPs only when triggered by qualifying events as defined by HHS on healthcare.gov; “special SEPs” created by HHS or BeWell that are not tied to qualifying events do not apply to off-exchange individual plans and carriers and brokers must not sell off-exchange coverage outside the off-exchange OEP or a qualifying-event SEP. Consumers seeking coverage must first be offered or referred to BeWell plans so they can access available financial assistance, and individuals who are outside the off-exchange OEP and not eligible for a qualifying-event SEP should be directed to BeWell during its OEP (November 1–January 15) or any HHS/BeWell special SEP; small group plans are exempt from OEP/SEP rules and may be purchased at any time.
