NY| ELANY Bulletin No. 2025-23 announces a new law in New York, effective November 15, 2025, that expands permissible medical expense indemnity insurance for assisted reproduction treatments like in-vitro fertilization and intrauterine insemination. Insurers can now indemnify intended parents for medical and other verifiable expenses related to such treatments when they do not result in a child’s birth, including travel and necessary living expenses for the surrogate. The law prohibits insurance from covering only medical or hospital expense co-pays, deductibles, or coinsurance, and mandates clear disclosure that these policies are not substitutes for comprehensive health insurance. For excess lines placements, brokers should use coverage code 7400 Donor Medical Expense Insurance and provide the required disclosure.
