Texas Amends Texas Administrative Code Regarding the Motor Vehicle Crime Prevention Authority (MVCPA) Pass-through Fee

TX| The amendments to Texas Administrative Code §5.205 regarding the Motor Vehicle Crime Prevention Authority (MVCPA) pass-through fee, effective April 30, 2025, implement Senate Bill 224 from the 88th Legislature, increasing the MVCPA fee from $4 to $5 to fund catalytic converter theft prevention. The amendments update the policyholder notice language and remove the specific fee amount from the rule text, instead referencing the Transportation Code.

In response to public comment, the requirement for insurers to file a new or revised notice with the Texas Department of Insurance was removed, unless the notice appears on a policy form, endorsement, or declarations page that requires approval under Insurance Code Chapter 2301.
