TX| The Texas Department of Insurance (TDI) issued a Bulletin B-0012-25 summarizing significant insurance-related laws enacted by the 89th Legislature in 2025. Several new requirements and reforms will affect entities regulated by TDI in areas including property & casualty, life & health, fire safety, and more. The laws include prohibitions on certain insurer practices, changes to funding and reporting, policyholder and provider protections, and new standards for fire safety and insurance pools.
Below list of each Bill and its topic:
- SB 1238: Prohibits insurance rate increases for widowed spouses based on marital status.
- HB 3689: Reforms Texas Windstorm Insurance Association (TWIA) funding structure.
- SB 213: Prohibits mandatory bundling of home and auto insurance policies.
- HB 2067: Requires disclosure of reasons for policy declinations, cancellations, and nonrenewals.
- SB 458: Mandates an appraisal process in home and auto insurance policies for loss disputes.
- SB 455: Requires in-state arbitration for surplus lines insurance policies covering Texas-only risks.
- HB 3388: Allows personal lines group policies (minimum 10 people); changes commercial group rules.
- SB 1644: Requires insurers to update insureds’ credit reports every three years for rating purposes.
- HB 2563: Creates prescribed burn manager self-insurance pool via Texas A&M Forest Service.
- SB 815: Regulates AI use in health utilization reviews and expands adverse determination disclosures.
- HB 138: Establishes Health Impact, Cost, and Coverage Analysis Program at UT Health Science Center.
- HB 3812: Reforms prior authorization “gold card” program; adds appeal and reporting requirements.
- SB 926: Allows health plans to steer/tier providers with a fiduciary duty to enrollees’ benefit.
- SB 2544: Sets deadlines for balance billing mediation dispute submissions.
- HB 3211: Requires transparent provider application and contracting process for vision plans.
- HB 2254: Permits value-based/capitated payments in EPO and PPO plans (prohibits global capitation).
- HB 4386: Sets deadlines for annuity contract surrender/transfer processes and interest penalties.
- HB 2516: Requires equal or limited pricing for Medicare supplement coverage for ALS/ESRD under 65.
- SB 896: Extends the newborn health coverage enrollment period from 31 to 60 days.
- HB 1899: Lowers age to obtain public fireworks display permit/license from 21 to 18.
- HB 2221: Updates rules on rebates and inducements for life, annuity, and health insurance.
- HB 3824: Requires fire safety standards/testing and inspections for battery energy storage systems.
