VA| Virginia Administrative Order No. 12209 approves ISO’s revised PP 01 99 01 27, Amendment of Policy Provisions—Virginia, as the mandatory Virginia-specific endorsement for use with the 2018 ISO Personal Auto Policy for policies effective January 1, 2027 and later. The replacement endorsement implements Chapter 898 of the 2026 Acts of Assembly and makes broad Virginia-specific amendments addressing minimum liability limits, newly acquired autos, liability and physical-damage coverage, claims duties, underwriting-related changes, cancellation/nonrenewal, and related policy provisions.
- Mandatory form transition: Insurers writing Virginia private-passenger auto insurance must use PP 01 99 01 27 in its precise approved language for policies effective on or after January 1, 2027; the prior PP 01 99 01 25 endorsement is withdrawn as of that date. Insurers are encouraged to promptly submit a SERFF Forms List filing acknowledging adoption of the new form.
- Most significant statutory implementation change: The endorsement defines Virginia “minimum limits” as $50,000 per person, $100,000 per accident for bodily injury, and $25,000 per accident for property damage. It also establishes a 45-calendar-day notice-and-verification framework before an insurer may add a person to the policy based solely on external information or a belief that the person resides with the named insured.
- Operational and product-review impacts: Carriers should complete a form-by-form gap analysis of policy issuance systems, rating and household-driver workflows, notices, cancellation/nonrenewal rules, claims handling, and training materials. Key policy changes include revised newly acquired auto provisions, revised liability and physical-damage terms, exclusion changes, a diminution-in-value exclusion, total-loss payments for applicable taxes and transfer fees in addition to policy limits, and a prejudicial-failure standard for certain post-loss duties.
