MI | Effective April 11, 2023, Michigan’s Clean Slate Law offers a process for the automatic record expungement for certain types and ages of offenses, including:
- Misdemeanors punishable by less than 92 days imprisonment (no limit), after a 7-year* waiting period
- Misdemeanors punishable by 93 days or more imprisonment (Up to 4), after a 7-year* waiting period
- Felonies (Not more than 2), after a 10-year** waiting period
Currently, Utah, California, Pennsylvania, and New Jersey also provide some type of automatic expungement, but these jurisdictions restrict automatic expungement to low-level misdemeanors only.
